1. About Perfect Assistance
Welcome to Perfect Assistance.
These Terms of Service apply when you visit www.perfectassistance.com.au, create an account, contact us or purchase products from our online store.
In these Terms, “Perfect Assistance”, “we”, “us” and “our” refer to the business operating www.perfectassistance.com.au. “You” and “your” refer to customers and visitors using our website.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell products online.
By accessing our website or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, you should not use our website.
Nothing in these Terms excludes, restricts or modifies any rights or consumer guarantees that cannot lawfully be excluded under the Australian Consumer Law.
2. Eligibility
You must be at least 18 years old to place an order through our website.
If you are under 18, you may only use the website or purchase products with the involvement and permission of a parent or legal guardian.
You must provide accurate, current and complete information when placing an order or creating an account.
3. Customer accounts
You may be able to create a customer account to manage orders and access certain website features.
You are responsible for:
- Keeping your login information secure.
- Providing accurate account information.
- Updating your details when they change.
- Activity conducted through your account.
You must notify us if you believe your account has been accessed without authorisation.
We may suspend or close an account if we reasonably believe it is being used unlawfully, fraudulently or in breach of these Terms.
4. Our products
Perfect Assistance supplies mobility, disability-support and daily-living products, including wheelchairs, mobility scooters, walking aids, bathroom-safety products, seating products and other independent-living equipment.
We take reasonable care to provide accurate product descriptions, specifications, images, dimensions, prices and availability information.
However:
- Product colours may appear differently depending on your screen.
- Images may show accessories that are not included.
- Measurements may be approximate unless stated otherwise.
- Packaging and product appearance may change.
- Manufacturers may update specifications without notice.
Please read the complete product description and specifications before ordering.
5. Product suitability and safety
Customers are responsible for checking that a product is suitable for the intended user, purpose and environment.
You should consider information such as:
- User weight and product weight capacity.
- Product measurements.
- Seat width and height.
- Mobility and transfer requirements.
- Intended indoor or outdoor use.
- Storage and transportation requirements.
- Assembly and maintenance instructions.
Products must be assembled, adjusted, operated and maintained according to the manufacturer’s instructions.
If you are uncertain whether a product is suitable, please obtain advice from an appropriately qualified healthcare professional, such as an occupational therapist, physiotherapist or medical practitioner, before purchasing or using it.
Information provided on our website is general product information and is not medical, therapeutic or clinical advice.
6. Orders
Submitting an order is an offer to purchase the products in your cart.
An automated order confirmation acknowledges that we received your order. It does not necessarily mean the order has been accepted.
Your order is accepted when we confirm acceptance or dispatch the products.
We may decline or cancel an order where reasonably necessary, including when:
- A product is unavailable.
- Payment cannot be authorised.
- The delivery information is incomplete or incorrect.
- An obvious price or product-information error has occurred.
- We reasonably suspect fraud or unauthorised activity.
- We cannot deliver the product to your location.
If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.
Please check your order carefully before submitting it. Changes or cancellations may not be possible after processing or dispatch has commenced.
7. Prices and GST
All prices displayed on our Australian website are in Australian dollars.
Prices include GST where GST applies unless clearly stated otherwise.
Delivery, installation or other applicable charges will be displayed at checkout or provided separately before payment.
We may change prices at any time, but changes will not normally affect orders already accepted.
If an obvious pricing error occurs, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected order for a refund.
8. Payments
You agree to provide accurate and complete billing and payment information.
By submitting payment details, you confirm that you are authorised to use the selected payment method.
Payments may be processed by Shopify Payments, PayPal, Afterpay or another payment provider. These providers may have separate terms, privacy policies and eligibility requirements.
We do not control whether a third-party payment provider approves or declines a transaction.
Products generally will not be dispatched until payment has been successfully received or authorised.
9. Promotions and discount codes
Promotions and discount codes may be subject to separate conditions, including:
- Start and end dates.
- Minimum-order amounts.
- Eligible or excluded products.
- Customer or usage limits.
- Delivery restrictions.
Unless stated otherwise, discount codes cannot be combined.
We may cancel or refuse a promotion that has been misused, obtained fraudulently or applied because of an obvious technical error.
10. Availability
Product availability may change without notice.
Adding a product to your cart does not reserve it. Occasionally, a product may become unavailable after an order is submitted.
If we cannot supply a product, we will contact you and offer an appropriate solution, which may include:
- A revised delivery estimate.
- An alternative product, subject to your agreement.
- Cancellation and a refund for the unavailable product.
11. Shipping and delivery
Perfect Assistance provides delivery within Australia, subject to product and location restrictions.
Delivery charges and estimated timeframes are explained in our Shipping Policy and, where applicable, displayed at checkout.
Delivery timeframes are estimates unless we expressly agree otherwise in writing.
Deliveries may be affected by supplier delays, courier operations, weather, remote locations, access difficulties or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address and informing us of relevant access requirements.
Additional charges may apply where:
- An incorrect address is supplied.
- Delivery must be attempted again.
- Special delivery or handling is required.
- Access restrictions were not disclosed.
- The product must be carried upstairs or through restricted access.
Please inspect your order promptly after delivery and contact us as soon as possible if a product is damaged, missing or incorrect.
12. Returns, exchanges and refunds
Returns, exchanges and refunds are managed according to our Refund Policy and the Australian Consumer Law.
Change-of-mind returns may be accepted only where the requirements in our Refund Policy are met.
Some products may not be eligible for change-of-mind returns, including certain:
- Personal-care or hygiene products.
- Products that have been used.
- Customised or specially ordered products.
- Products that cannot be resold for health or safety reasons.
These exclusions do not affect your rights where a product is faulty, unsafe, incorrectly described or otherwise fails to meet a consumer guarantee.
13. Australian Consumer Law
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the nature of a failure, customers may be entitled to a repair, replacement, refund or compensation for reasonably foreseeable loss or damage.
Manufacturer warranties are provided in addition to your Australian Consumer Law rights. They do not replace or limit those rights.
Proof of purchase may be required when requesting a remedy.
More information about Australian consumer guarantees is available from the Australian Competition and Consumer Commission.
14. Manufacturer warranties
Some products include a manufacturer’s warranty.
The duration, coverage and exclusions may differ between products and manufacturers. Warranty information may be displayed on the product page, included with the product or provided upon request.
A manufacturer’s warranty may not cover damage caused by:
- Misuse or neglect.
- Normal wear and tear.
- Accidents or impact damage.
- Unauthorised modifications or repairs.
- Failure to follow instructions.
- Use outside the product’s intended purpose.
- Exceeding the stated weight capacity.
Manufacturer-warranty conditions do not limit rights available under the Australian Consumer Law.
15. Website content
We aim to keep our website accurate and current, but information may occasionally contain typographical errors, omissions or inaccuracies relating to:
- Product descriptions.
- Specifications.
- Prices.
- Promotions.

We may correct or update website information when an error is identified.
If an error materially affects an order, we will contact you and provide an appropriate option.

22. Website availability
We take reasonable steps to maintain the security and availability of our website.
However, we cannot guarantee that the website will always be uninterrupted, error-free or available. Access may occasionally be restricted for maintenance, updates, technical problems or circumstances outside our control.
23. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the Australian Consumer Law.
To the maximum extent permitted by law, Perfect Assistance is not responsible for indirect or consequential loss arising solely from:
- Misuse of a product.
- Failure to follow product instructions or safety warnings.

This provision does not apply to loss caused by our negligence, unlawful conduct or breach of applicable consumer guarantees.
25. Suspension and termination
We may suspend or terminate access to an account or the website where reasonably necessary because of:
- Fraudulent activity.
- A security risk.
- Unlawful conduct.
- A serious breach of these Terms.
Termination does not affect rights or obligations that arose before termination, including outstanding payment obligations.
26. Severability
If part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary.
The remaining provisions will continue to apply.

These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
